1. GENERAL

1.1 These terms and conditions (”TOC”) apply when you make a purchase via www.denjodogs.com/se, (”the Site”). The Site is available only to individuals. A binding agreement is made between you and Denjo Dogs AB (“Denjo”). Contact details and other information about Denjo is found on the website.

We encourage you to read Denjo’s TOC in their entirety before submitting an order. The TOC may be updated and vary from time to time why we recommend you to read the TOC before every purchase you make on the Site.

1.2 In order to make a purchase on the Site you need a delivery address within one of the regions Denjo deliver to and you need to be 18 years or older. Denjo reserve the right to cancel or change your order in special cases such as when you’ve supplied Denjo with incorrect personal information or have payment remarks. Denjo reserves the right to terminate a purchase in the event of any suspicion of fraud.

1.3 Denjo reserve the right for technical issues, printing errors, price adjustments, price errors, stock errors and colour deviations in products presented on the Site. If Denjo discover any of these errors or techincal issues we reserve the right to change and update this information at any time. If we discover a price error we will let you know as soon as possibl and await your approval of the correct price before completing your purchase.

All image information on the Site shall be seen as illustrations and can not be guaranteed to reproduce the exact appearance and nature of the product. Denjo is not responsible for the information on the Site that is given from a third party, such as a supplier.

1.4 The Site, including all content and information, is owned by Denjo or its licensors or suppliers. The content and information is protected by intellectual property laws and market laws. This means that logotypes, company names, product names, images, graphics, design, text, layouts, other software and information about goods, services and other content may not be copied or used without written permission from Denjo.

2. ORDERS
2.1 A purchase is made on Denjo’s website www.denjodogs.com/se. If you have any questions about how to make a purchase, please contact our customer service via email info@denjodogs.com. A completed purchase made on the Site means you accept Denjo’s TOC. By accepting the TOC you agree to comply with the TOC in their entirety and agree that you have read the information about personal information and agreed to the use of names, personal information and cookies.

2.2 A binding agreement is entered into when Denjo has confirmed your order and you have received an order confirmation from Denjo by email. Denjo recommend you to save this order confirmation for any contacts with Denjo’s customer service. You can withdraw your order until it is confirmed by Denjo. If the order is cancelled or revoked, Denjo will refund any payments that you or the company whose payment solution you used have made in regards to the order.

2.3 Denjo reserve the right to cancel or change orders if delivery for some reason can not be made. If you have made several purchases we reserve the right to send them all together in one parcel.

3. PERSONAL INFORMATION
3.1 When you make a purchase, you agree that we store and use your information in Denjo’s business in order to complete your order and provide the service that you can expect from us. According to Swedish Personal Data Act you have the right to receive the information we have registered on you. If you consider it to be incorrect or irrelevant you can request correction or removal from our register at any time. Contact our customer service at info@denjodogs.com and we will help you.

3.2 The information you provide about yourself is used by Denjo and our partners for payment, delivery and to contact you. We guarantee that no information about you will be passed on or sold to third parties. Denjo uses information from the customer register for mailings about our products, blog posts and company news via Denjo’s newsletter. You can cancel your subscription at any time, either via the link in the newsletter or by contacting our customer service at info@denjodogs.com.

4. PRICES, FEES & PAYMENT
4.1 When making a purchase on the Site, the prices stated on the Site apply. Prices are shown in Swedish SEK including 25% VAT for all countries within EU. Prices do not include payment and shipping fees, which are stated separately and vary depending on which shipping alternative and payment option you choose when placing your order.

4.2 In collaboration with Klarna we offer different payment solutions. By leaving information at the checkout, you accept Klarna’s terms of use. By clicking on “Complete purchase”, you accept Denjo’s general TOC.

4.3 If you choose invoice payment or partial payment, Denjo or its partners can make a credit check. Denjo and its partners have the right to do a credit check where necessary to be able to grant credit time. In such case, you will be informed of this. As a customer, you undertake to pay within the set time for the chosen payment method. Payment after the due date can lead to late fees and interest.

4.4 Denjo reserve the right not to always offer all payment methods, or to change payment methods if the one you have chosen for any reason does not work at the time of purchase.

5. FREIGHT & DELIVERY
5.1 Denjo use Postnord and DHL services to send orders.

5.2 Products in stock is sent out within 1-2 workdays. For goods that are not in stock (backorder) and special orders like personal engraved products the delivery cuts no later than 30 working days from the time Denjo confirmed the order in writing through the order confirmation. Denjo reserves the right to deliver all goods ordered at the same time, i.e. if one of the products ordered is not in stock, Denjo waits for a re-stock of that product before the entire order is sent.

5.3 When the order has left our warehouse, the delivery responsibility is passed on to the shipping companies (DHL or Postnord) who will deliver your order within their normal delivery time. Denjo does not provide a late guarantee for goods that are not in stock (backorder) at the time of ordering or for goods that have left our warehouse. This means that the total delivery time may be longer than what is stated as normal on the Site due to delays from suppliers or shipping companies.

5.4 Denjo is responsible for goods that are damaged or lost during delivery to you. Complaints about freight damage must be made within a reasonable time, preferably within 24 hours of receipt of delivery. When receiving the shipment, it is therefore important that you check that the goods have not been damaged during transport. Denjo recommends that you report any transport damage directly on site to the delivery agent and then contact Denjo’s customer service. Remember to keep all packaging and product packaging in the event of a freight damage and take a picture of the damaged packaging as well as damaged product.

5.5 The expected delivery time of the product is stated on the order confirmation, at checkout and/or on the current product page on the Site. Unless otherwise specifically agreed and a delivery takes more than 30 working days and this does not depend on you as a customer, you have the right to cancel the purchase. There may be times that make it impossible for us to fulfill the order, for example if our supplier is unable to fulfill its commitment to us. Contact our customer service at info@denjodogs.com if you wish to cancel your purchase.

5.6 If packages are to be redeemed, you must do so within the time specified in the notification. Packages must normally be picked up in person with valid identification and order number. You will always receive a notification showing where and when packages are to be picked up. Notification can be made via e-mail, regular mail and if you have provided a mobile number, also via SMS. If you do not pick up the package, Denjo has the right to charge you a fee of SEK 249 for costs attributable to Denjo’s administration, shipping, return shipping and handling. If you have given Denjo the wrong email address and the package is sent back you will also be charged. So check that you receive an order confirmation by email when you’ve placed your order.Uncollected packages are not covered by the right of withdrawal. Please note that if you regret a purchase and want to return the item, you first need to pick up the package and then return as described below so as not to be charged SEK 249.

6. RIGHT OF WITHDRAWAL/ RETURN
6.1 When you make a purchase on Denjo’s Site you always have 14 days of withdrawal. The 14-day period is counted from the delivery of the last good(s) in your order.

6.2 The right of withdrawal does not apply for the following goods:

(a) goods that have been manufactured according to your special instructions or have been given a personal touch. Such as name tags personally engraved or dog beds with a special text on;

(b) goods where the seal is broken and can not be returned due to health and hygiene reasons. For instance fur products, treats and dog toothpaste;

(c) used goods;

(d) damaged goods.

6.3 If you wish to withdraw the purchase, you must, before the withdrawal period has expired, send a message stating clearly that you want to use your right of withdrawal. The message must be sent via Denjo’s digital return form. You must enter the following information:

a) order number (see your order confirmation and/or delivery note)

b) your name and contact details

c) Number of products and name plus barcodes on each of these products you wish to return

6.4 When using the right of withdrawal, you pay the return shipping fee and are responsible for the condition of the goods after you have received the goods and during the return shipping. If you choose to use the Denjo Dogs return freight label we will deduct the actual return freight fee from your refund.

6.5 It is important that the product can not be damaged during transport. In order for a full refund to be made, the product must be unused and sent back in undamaged original packaging, all labels must remain and any manuals must be sent. It is important that outer packaging is used and that tape or other material is not pasted on the original packaging. The item must be returned within 14 days from the date the notice of using the right of withdrawal was submitted to Denjo. Returns must be made to Denjo according to the methods and instructions specified by Denjo.

6.6 When you withdraw your purchase, Denjo will refund the amount you paid for the item, excluding delivery costs and other services linked to delivery. On the amount to be refunded, Denjo has the right to deduct an amount corresponding to the depreciation of the product compared to the original value of the product, if and to the extent that such depreciation is due to the fact that you have handled the product to a greater extent than necessary to determine its properties or function.

6.7 Denjo will refund the amount as soon as possible, but no later than within 30 days from the date Denjo received and checked the returned item. The refund will be made to you via the payment option you have chosen, provided that nothing else has been agreed or that there are obstacles to such a refund. If you have an unpaid invoice for your order, it is important that you push the due date yourself. Please go to www.klarna.com to do this.

6.8 In the case of purchases that entitle to a gift or extra discount, the value of the gift or the extra discount is considered a general discount on the entire amount at the time of purchase. If any part of the purchase is exchanged and / or returned, returned goods are valued at the purchase price minus their relative share of the general discount. In the case of exchanges, there is no recalculation of the original basis for gift or discount.

7. WARRANTY & RECLAIMS
7.1 Some of Denjo’s products may be covered by a warranty. Information about any warranty period and special warranty terms for each item can be found on the Site. Any warranties are valid only for individuals who buy from the Site, i.e. not second hand goods.

7.2 If an item deviates from what follows from the agreement between you and Denjo, the item can be returned. Warranty and warranty rights for goods only cover original manufacturing defects, and thus not defects that occur during or after a personal change in the product’s function and appearance, such as sewing adjustment, upgrading or other configuration of the product. The right of complaint also does not cover defects caused by normal wear and tear such as when your dog bite on a product. Your order confirmation is valid as proof of warranty.

7.3 The right of complaint covers goods that are defective in accordance with current consumer protection legislation. Customers who wish to make a reclaim on a product must contact Denjo as soon as possible after the error has been discovered. Contact is made via the contact information stated on the Site. Complaints must be made within a reasonable time after the error is discovered. Denjo appreciates if a complaint is made within 14 days of the defect being discovered, but no later than three years after the date of purchase.

7.4 Denjo is responsible for costs of return shipping for approved complaints. Denjo will provide the customer with a return label. All returns for approved complaints shall be left at a pick-up point. If the customer choose to add extra services like pick up at home or express delivery the extra cost for this will be applied to the customer’s invoice.

7.5 In the event of complaints, Denjo reserves the right to firstly remedy the defect, secondly to re-deliver a new equivalent product, thirdly to give a price deduction or compensation for correcting the defect and last a refund of the reclaimed product.

7.6 When a reclaimed item is returned and the complaint is approved, Denjo will compensate you. Denjo strives for this to happen within 30 days of Denjo receiving the complaint, but it may take longer depending on the type of item. Denjo reserves the right to refuse a complaint if it turns out that the product is not defective in accordance with current consumer protection legislation. In the event of complaints, Denjo follows guidelines from the Swedish General Complaints Board. More information is available at www.arn.se and www.konsumentverket.se.

8. LINKS
Denjo may link to other sites beyond Denjo’s control, and sites outside of Denjo’s control may link to the Site. Although Denjo strives to ensure that Denjo only links to websites that share Denjo’s privacy and security regulations in accordance with the Privacy Policy, Denjo is not responsible for the protection or privacy of information or personal data that you provide on other websites. You should take caution and read the personal data regulations for the relevant Site.

9. FORCE MAJEURE
Denjo is not responsible for delays caused by circumstances that Denjo could not control such as general labor dispute, war, fire, lightning, terrorist attack, changed government regulation, technical problems, errors in electricity / telecommunications / data connections or other communication and errors or delays in services from subcontractors due to circumstances stated here. These circumstances shall constitute grounds for exemption which entail exemption from damages and other sanctions. Should any such situation arise, Denjo will inform you at the beginning, continuously and at the end of the time for the current situation. If the circumstance has lasted longer than two months, both you and Denjo have the right to cancel the purchase with immediate effect.

10. CHANGE OF TERMS AND CONDITIONS
Denjo förbehåller sig rätten att göra ändringar i dessa Villkor när som helst i tiden. Alla ändringar av dessa Villkor kommer att publiceras på Sajten. Ändringar gäller från det att Du har accepterat Villkoren (i samband med ett nytt köp eller vid besök på Sajten), alternativt 15 dagar efter att Denjo har informerat dig om ändringarna. Denjo rekommenderar dock att Du håller dig uppdaterad på Sajten regelbundet för att få vetskap om eventuella ändringar av Villkoren.

Denjo reserves the right to make changes to these TOC at any time. All changes to these TOC will be published on the Site. Changes apply from the time you have accepted the TOC (in connection with a new purchase or when visiting the Site). Denjo recommends that you stay updated on the Site regularly to be informed of any changes to the Terms.

11. REVIEWS
By submitting reviews for goods on denjodogs.com/se, you give Denjo the right to publish them on www.denjodogs.com/se and in other channels and media.

12. INVALIDITY
Should a competent Swedish court, authority or arbitral tribunal find that any provision of these TOC is invalid or unenforceable, the provision in question and all other provisions shall be valid and enforceable to the extent permitted by applicable law. The provisions declared invalid or unenforceable will be replaced by relevant legal guidelines and advice.

13. APPLICABLE LAW & POTENTIAL DISPUTES
13.1 Disputes must primarily be resolved by agreement after discussion with Denjo’s customer service.

13.2 If a dispute cannot be resolved in agreement with Denjo’s customer service, you as a customer can turn to Swedish ARN (the Swedish General Complaints Board). You can also file complaints online via the European Commission’s dispute resolution platform. You can find the European Commission’s platform here. If you submit a complaint via this platform, your case is automatically forwarded to the appropriate nationally responsible dispute resolution body. This dispute resolution body then contacts Denjo and seeks to resolve the dispute without interfering with the court. In the event of a dispute, Denjo follows a decision from Swedish ARN or an equivalent dispute resolution body.

13.3 Disputes concerning the interpretation or application of these TOC shall be interpreted in accordance with Swedish law and settled in accordance with clause 13.2 above or ultimately by a general court.

These TOC have been established by Denjo on October 30, 2017.
